The Process of a Compensation Claim

“For some, the process of claiming compensation can seem quite daunting, and many people choose not to pursue what they are entitled to as they believe it to be not worth the hassle.  At the Paul Rooney Partnership, we aim to make the process a smooth one, with as little disruption to your personal life as possible.

If you are unsure as to whether you have a viable case for compensation, then we have solicitors with the appropriate expertise and experience to advise you on your claim. During your initial contact with one of our solicitors, you will need to provide a number of details about the case in order for us to properly assess your claim. You will be asked to describe in detail what happened before, during and after the incident. We will need to know if the accident was reported to anyone, and if so, who it was reported to. We will also ask to see any photographs that may be available.

If there were any witnesses to the accident, then you will need to obtain their names and addresses, as well as statements from them in order to back up the claim. A medical report will be required to properly assess the extent of your injuries and any lasting effects, as this will determine the amount of compensation you may be entitled to.

If we need to see you and you are unable to come to our offices to discuss your claim as a result of your injuries, then we are more than happy to come visit you either at your home or in hospital.

Once your claim has been fully investigated and assessed, a letter containing full details of the claim will be sent to the person or organisation responsible for your accident, and their insurance company will then get involved in the case.

The insurance company has a period of up to three months to investigate the claim themselves, and to confirm whether or not they are willing to accept responsibility for the accident.

If an agreement cannot be reached, then we will press with court proceedings. Your solicitor will advise you on the particulars of this process, should the situation arise. But the majority of cases are settled without the need for a trial.
